Policy 8.21 - Christmas Tree Program-Permit Replacement

Scope

This policy guides the replacement of Christmas tree permits in the Christmas Tree Program.

Policy

It is the policy of this Ministry that, where replacement of a Christmas tree permit is requested:

  • the District Manager shall conduct a review of the permittee's performance prior to his making a replacement offer; and
  • the terms and conditions of the replacement offer made by the District Manager shall reflect the findings of the review.

No Replacement

An offer to replace a Christmas tree permit shall not be made where that licence has no provision for replacement.

Replacement is not automatic, and only should be offered to permittees that have performed in a satisfactory manner.

Performance Review

A performance review of a Christmas tree permit shall include:

  • office review of compliance with management plan, permit conditions, and administrative requirements of the Christmas tree permit; and
  • field review of forest practices and compliance with management plan and permit conditions.

The permittee or a representative should accompany Forest Service staff during the field review.

The results of the review should be discussed with the permittee before they are incorporated into the replacement offer.

Term

The term of the replacement permit shall commence on the fifth anniversary of the existing permit and be for a term equal to the whole original term of the existing permit.

Permit Area

The permit area of the replacement Christmas tree permit will normally describe the same area as the existing Christmas tree permit.

The District Manager may make minor revisions to the boundaries of Christmas tree permits at replacement to improve forest resource management.

Timeline

The District Manager should, two months prior to the fourth anniversary of a Christmas tree permit, send a written reminder to the permittee to request replacement of the permit.

The Forest Service must have the performance review completed so that a replacement offer can be made six months prior to the fifth anniversary of the Christmas tree permit.
