Scope

This policy establishes the criteria for exchanging or deleting private land from woodlot licences (Forest Act, s.54). It applies to all woodlot licences.


Policy

It is the policy of this Ministry that:

  • the prior written consent of the Minister is required to delete private land from a woodlot licence, or to dispose of an interest in private land in a woodlot licence
  • the prior consent of the Minister is required to exchange private land within a woodlot licence

Impact on Management

The review of all requests for deleting or exchanging private land will consider the impact of the request on forest resource management within the woodlot licence.

Increased Productivity

Generally, the granting of the request to exchange land should not negatively affect the allowable annual cut of the woodlot licence. Thus, any request to replace land of a lower productivity with land of a higher productivity would generally receive a favourable recommendation.

Higher or Better Use

Requests to delete a minor portion of private land for a 'higher or better use' would generally receive a favourable recommendation.

Management Plan

The woodlot licence management plan will be revised within a reasonable time of the granting of the deletion or exchange of private land in the woodlot licence and continue to define the proportion of the harvest between private and Crown land.
