DELEGATION REGULATION

Definition

1. In this regulation "Act" means the Forest Practices Code of British Columbia Act.

 

District manager's authority to delegate

2 (1) A district manager may delegate to any person employed in the Ministry of Forests his or her functions under

(a) section 21 to 33, 35 to 41, 44, 49, 50, 52, 54, 59 to 61, 63 (5), or (7), 64, 65, 69, 74, 101 (1) or (1.1), or 240 of the Act, or

(b) a regulation made under the Act.

(2) Despite subsection (1), this regulation does not authorize a district manager to delegate his or her functions

(a) under section 40 or 41 of the Act with respect to a forest development plan or silviculture prescription, or

(b) respecting the following matters:

(i) public review of and comment on a forest development plan;

(ii) the content, term or referral of a forest development plan;

(iii) the content or referral of a silviculture prescription;

(iv) an assessment that must be completed before the review or approval of a forest development plan or silviculture prescription;

(v) maximum allowable cutblock size, green-up, ungulate winter range, general wildlife measures or regionally important fish.

(3) Subsection (2) does not limit the ability of a district manager to delegate his or her functions respecting an amendment to a silviculture prescription.
