PROVINCE OF BRITISH COLUMBIA

Forest Practices Code of British Columbia Act

Section 70(4)(c) requires that tree seed must be used in accordance with the regulations and standards. For more information on forest management and practices in BC, go to the Forest Practices Code webpage.

Timber Harvesting and Silviculture Practices Regulation (s. 38) and Woodlot Licence Management Regulation (s. 82)

These "transition" regulations under the Code Act describe the use, storage and record keeping requirements of tree seed and vegetative material. Reporting requirements are described in Part 6 and Forms of the former regulation. and s. 89 of the latter, respectively.

Tree Cone, Seed and Vegetative Material Regulation

This regulation covers the collection, registration, processing and disposition of tree cones, seed, and vegetative material.

Administrative Remedies Regulation

This regulation describes the maximum penalties that may be administered for non-compliance with section 70(4) of the Act and the regulations.

Seed and Vegetative Material Guidebook

This Forest Practices Code guidebook provides interpretation and guidance for the above regulations. It also contains the Provincial Seed and Vegetative Material Guidelines, which are cited in the Timber Harvesting and Silviculture Practices Regulation and Woodlot Licence Management Regulation. These guidelines are also updated from time to time as identified in the Chronological Summary of Transfer Guideline and Seed Planning Zone Changes in British Columbia

Ministry Policy 2.1 - Seed Orchards and Production Facilities

This policy covers the licensing, evaluation and audits of seed orchards and production facilities. It also establishes the policy for the technical registration standards referenced below and describes the respective responsibilities of ministry staff.

Ministry Policy 2.2 - Cone and Seed

This policy covers the cone and seed services offered by the ministry. It describes the requirements for collections, cone and seed quality, processing, registration, storage, allocations, fees, and other related ministry responsibilities.  

Technical Standards for the Registration of Seed and Vegetative Lots derived from Seed Orchards and Production Facilities.

This document describes how transfer standards, genetic diversity, and genetic worth of improved material are to be determined. It also includes requirements for field testing material derived from new technologies and provisions for conditional use.

Protocols for Rating Seed Orchard Seedlots in British Columbia

This report describes procedures for rating the genetic quality of seed orchard seedlots.  These expand upon the requirements of the technical registration standards.

GOVERNMENT OF CANADA

Seeds Act

This act, and its regulations, govern the testing, inspection, quality and sale of seeds.  The Seeds Act, its regulations and information requirement guidelines also apply to seed derived through biotechnology, including plants with novel traits (or genetically modified plants).

Plant Protection Act

The purpose of this Act, and it regulations, is to protect plant life and the agricultural and forestry sectors of the Canadian economy by preventing the importation, exportation and spread of pests and by controlling or eradicating pests in Canada. 

Also refer to the Canadian Food Inspection Agency which is responsible for administering these federal acts, regulations and their guidelines. Questions regarding the transfer of tree seed and seedlings to, from and within Canada should be directed to the CFIA.
