From: webserver@fsiass7.for.gov.bc.ca Sent: 2003-05-01 1:43 PM To: your-email-address Cc: Forest Officer Subject: Free Use Permit **MoFWebMail Information** ** Server:www.for.gov.bc.ca::142.36.141.103 ** User: **Referer:http://www.for.gov.bc.ca/dsq/OpPlaning/freeCut/apply.htm ************************************************************************* INSTRUCTIONS: PRINT OUT THIS PERMIT AND CARRY IT WITH YOU ************************************************************************* FREE USE PERMIT FILE NO. 19520-20/General Permittee: Your Name Address: Your Address Phone: (604) 555-5555 Under Section 49 of the Forest Act, the parties agree as follows: 1.00 GRANT OF RIGHTS 1.01 Subject to this Free Use Permit and in consideration of the Permittee’s covenants in it, the District Manager of the Squamish Forest District (the District Manager) grants to the Permittee, during the term of this Permit: a) the right to enter and occupy Crown land in the permit area described in paragraph 1.02 for the purpose of harvesting Crown timber according to the terms of this Permit and the Forest Act; and b) the right to harvest downed Crown timber designated for harvesting under this Permit, for the following purposes and for the following volumes: - Firewood for personal domestic use only and not for sale to others, up to a maximum of 4 cords (approximately 10 pickup loads). 1.02 Subject to paragraph 1.03, the permit area is the following Crown lands named here within the Squamish Forest District: a) the area within the right-of-way of any industrial logging road located on Crown land (the right-of-way width extends 37.5 metres either side of the road centre); b) the area within previously harvested, non-active logging blocks located on Crown land; c) the area within the BC Hydro right-of way located on Crown land. 1.03 The cutting or removal of firewood is prohibited from the following areas of Crown land: a) any Crown land within the Village of Lions Bay, the Village of Pemberton, the Resort Municipality of Whistler and the District of Squamish; b) any land within a woodlot licence area unless authorized otherwise by the holder of the Woodlot Licence; c) any lands within Tree Farm Licence 38 unless authorized otherwise by the licence holder (Northwest Squamish Forestry Limited Partnership). Individuals wishing to collect firewood within Tree Farm Licence 38 should contact Northwest Squamish Forestry c/o 604-892-3501; d) any area within 20.0 metres of the high water mark of a stream that has a width of 5.0 metres or greater; e) any area within 5.0 metres of the high water mark of a stream that has a width less than 5.0 metres and any area within 5.0 meters of any wetland or lake. 1.04 This Free Use Permit will come into effect on (insert date) and, unless previously canceled by the District Manager or a Forest Officer, will expire 60 days later. 2.00 CONDITIONS AND CANCELLATION 2.01 In operations carried on under this Free Use Permit: a) the Permittee will use the timber harvested under this Free Use Permit only for the purposes of firewood removal; b) the Permittee will comply with the Forest Act and the Forest Practices Code of British Columbia Act and their regulations; c) the Permittee shall not cut any Western Red Cedar or Cypress blocks, shake blanks, fence posts, rails, or any special forest products; d) the Permittee shall not cut any standing trees, dead or alive; e) the Permittee must comply with the Forest Fire Prevention and Suppression Regulation (shovel, ax, muffler in good repair, fire extinguisher at hand) between April 1 and October 31; f) the Permittee shall keep free of slash and debris all ditches and roads; g) the Permittee shall, at no time, block off roads or disrupt traffic; h) the Permittee will assume all risk of loss or injury, and indemnify and save harmless the Crown of all claims, costs, expenses, and loss of face, incurred or suffered by the Crown directly or indirectly; i) this Free-Use-Permit must be carried by the Permittee when cutting and/or transporting wood cut under this authority; j) it is the Permittee’s responsibility to insure that cutting and removal of firewood is carried out on Crown land only. 2.02 In operations carried on under this Free Use Permit, the Permittee will not cause or permit: a) a lake, stream, spring or tidal water that supplies water for any purpose to be rendered unfit for that purpose; or b) trees, logs, logging debris or any polluting substance to be deposited below the natural boundary of a lake, stream, spring or tidal water; or c) slash to be burned closer to a lake or stream than the distance specified in writing by a Forest Officer. 2.03 In operations carried on under this Free Use Permit, the Permittee will: a) if it is in contravention of paragraph 2.02, within the time specified in a notice delivered to the Permittee by a Forest Officer, remove any debris or other polluting substances deposited in, on or below the natural boundary of a lake, spring, stream or tidal water; and b) protect natural growth below the natural boundary of a lake, stream or tidal water from damage from wood cutting. 2.04 This Free Use Permit is subject to suspension or cancellation by the District Manager or a Forest Officer without notice.
