From: webserver@fsiass7.for.gov.bc.ca Sent: 2003-05-01 1:43 PM To: your-email-address Cc: forest officer Subject: Free Use Permit **MoFWebMail Information** ** Server:www.for.gov.bc.ca::142.36.141.103 ** User: **Referer:http://www.for.gov.bc.ca/dck/OpPlaning/freeCut/apply.htm ****************************************************************************************** INSTRUCTIONS: PRINT OUT THIS PERMIT AND THE MAP OF THE APPROPRIATE PERMIT AREA, AND CARRY THEM WITH YOU ****************************************************************************************** FREE USE PERMIT NO. 19520-20/Misc Permittee: Your Name Address: your address Phone: (604)555-5555 Under Section 49 of the Forest Act, the parties agree as follows 1.00 GRANT RIGHTS 1.01 Subject to this Free Use Permit and in consideration of the Permittee's covenants in it, the District Manager of the Chilliwack Forest District (the "District Manager") grants to the Permittee, during the term of this Permit: a) the right to enter and occupy Crown land in the permit area described in paragraph 1.02 for the purpose of harvesting Crown timber according to the terms of this Permit and the Forest Act; and b) the right to harvest Crown timber designated for harvesting under this Permit, for the following purposes and in the following volumes: Forest Act Section 48(1)(b) Firewood for personal domestic use only up to 18 cubic metres (5 cords or approximate 12 regular Pickup Truck loads). 1.02 The permit area is in the HarrisonEast area and is the land outlined in the bold line on the map attached to this Free Use Permit. 1.03 The Free Use Permit will come into effect on 2003/05/01 and, unless previously canceled by the District Manager or a Forest Officer, will expire one year after the effective date. 2.00 CONDITIONS AND CANCELLATION 2.01 In operations carried on under this Free Use Permit: a) the Permittee will use the timber harvested under this Free Use Permit only for the purposes specified in paragraph 1.01; b) the Permittee will comply with the Forest Act and regulations; c) the height of stumps shall be as low as practicable, and in no case higher than 30cm; d) dead timber, standing and down, shall be used, where available; and e) slash resulting from operations carried on under this Free Use Permit will be disposed of as follows: All debris to be scattered as low as possible to the ground. No debris to be placed on trails and roads. 2.02 In operations carried on under this Free Use Permit, the permittee will not cause or permit: a) lake, stream, spring or tidal water that supplies water for any purpose to be rendered unfit for that purpose; or b) trees, logs, logging debris or any polluting substances to be deposited below the natural boundary of a lake, stream, spring or tidal water; or c) logs to be skidded or equipment to be operated below the natural boundary of a lake, stream or tidal water 2.03 In operations carried on under this Free Use Permit, the Permittee will: a) If it is contravention of paragraph 2.02, within the time specified in a notice delivered to the Permittee by a Forest Officer, remove logging or road-building debris or other polluting substances deposited in, on or below the natural boundary of a lake, spring, stream or tidal water, b) fall or yard timber away from the natural boundary of a lake, stream or tidal water, c) protect natural growth below the natural boundary of a lake, stream or tidal water from damage from logging and burning f) comply with all applicable legislation and regulations thereunder, as directed in writing by a Forest Officer. 2.04 Additional Provisions: All felled trees must be utilized. No coniferous trees to be cut 2.05 This Free Use Permit is approved by the District Manager on the condition that the Permittee does not, and during its term will not, have on land he/she owns or occupies, sufficient timber that is reasonably accessible for the purpose specified in paragraph 1.01. 2.06 If an obligation set out in this Free Use Permit is not performed, or if the condition set out in paragraph 2.05 is not met, the District Manager or a Forest Officer may, without notice, suspend this Free Use Permit, or cancel it, or both. 2.07 The following must be complied with during fire season (between April 1st and October 31st): the fire danger class must be obtained from a designated forest official to determine if any restictions exist. If the number of persons who normally work at a worksite is 3 or less, the person carrying out the industrial activity must ensure that the following fire fighting tools are kept at the worksite: (a) one round-nosed shovel; (b) one pulaski tool or mattock; (c) one hand-tank pump containing at least 18 litres of water. Refer to Parts 1, 2 and 3 of the Forest Fire Privention and Suppression Regulation. A person must not operate a small engine (i.e. powersaw) unless: (a) the muffler on the small engine is maintained in good repair, and (b) there is available at all times a fire extinquisher charged with at least 0.225 kg (8 oz) of fire extinguishing chemical. 2.08 Persons engaged in firewood cutting activities on the designated area will assume all risk of losss or injury and will indemnify and save harmless the Crown of all claims, costs, expenses and losses faced, incurred or suffered by them directly or indirectly.
