What's New in FRPA - 2005

Effective February 22, 2005, amendments were made to the Forest and Range Practices Act to extend the transition period by one year. The amendments were included in the Miscellaneous Statutes Amendment Act, 2005 (Bill 3).

Effective February 25, 2005, the Forest Planning and Practices Regulation (FPPR) was amended to provide Code equivalency for the environmental standards for community watersheds and fisheries sensitive watersheds.

All Community Watersheds that were established under FPC provisions before January 31, 2004 are continued for the purposes of FRPA. An objective has been established in FPPR for these watersheds to continue management under FRPA. The objective is effective immediately. For planning areas that include a continued Community Watershed, plan content must be consistent with the objective.

The FPPR now includes an objective for Fisheries Sensitive Watersheds, and a schedule that identifies the Fisheries Sensitive Watersheds that are continued into FRPA. If a Forest Development Unit encompasses any area of a watershed identified in the regulation, plan content consistent with the objective in regulation is required. The regulation changes for FSW are in effect immediately.

FRPA Act and Regulations Changes - Dec. 13, 2004

On December 13th, 2004, most remaining provisions in Bill 33 respecting the Forest and Range Practices Act were brought into force, and a number of changes were made to the following regulations:

  • Administrative Remedies Regulation,
  • Forest Planning and Practices Regulation,
  • Security for Forest and Range Practice Liabilities Regulation, and
  • Woodlot Licence Planning and Practices Regulation.

In particular, the Forest and Range Practices Act includes the amendments made by sections 79, 80, 81, 83, 84, 89, 90 94, 97 and 102 of the Forests Statutes Amendment Act, 2004, which were brought into force effective December 13, 2004.

In addition, the Government Actions Regulation was repealed and replaced to:

  • correct drafting oversights,
  • provide for an extended transition to the Forest and Range Act to December 31, 2005, and,
  • to address operational issues identified since the FRPA regulations were brought into force in January 31, 2004.
