Appendix 1.

Community watershed advertisement

The following section outlines advertising requirements for establishing, varying or cancelling a community watershed designation according to the Forest Practices Code of British Columbia Act.

Operational Planning Regulation (amended by B.C. Reg. 249/95, s.11), Part 11 Community Watersheds

Community watershed designation: review and comment

  1. Before establishing, varying or cancelling a community watershed designation under section 41 of the Act, the regional manager must publish in a newspaper a notice stating

    1. that a community watershed is proposed to be established, varied or cancelled under section 41 of the Act,

    2. the location of the community watershed that is proposed to be established, varied or cancelled,

    3. that the following are available at the ministry regional office and district office:

      1. a copy of the proposed order establishing, varying or cancelling the community watershed designation;

      2. a map showing the location and boundaries of the community watershed that is proposed to be established, varied or cancelled, and

    4. that comments on the proposal may be delivered to the ministry regional office or district office within 60 days of the date of publication in the newspaper.

Community watershed designation: notice of an impending order

  1. When establishing, varying or cancelling a community watershed designation under section 41 of the Act, the regional manager must publish in a newspaper, a notice stating

    1. that a community watershed is to be established, varied or cancelled under section 41 of the Act,

    2. the location of the community watershed that is to be established, varied or cancelled,

    3. that the following are available at the ministry regional office and district office:

      1. a copy of the order establishing, varying or cancelling the community watershed designation;

      2. a map showing the location and boundaries of the community watershed that is to be established, varied or cancelled, and

    4. the date the order takes effect.
Below is a sample advertisement for the proposed designation of a new community watershed. Replace bold type where appropriate.

Notice of Public Review

PROPOSED DESIGNATION OF COMMUNITY WATERSHEDS

Notice is hereby given that the regional manager of the Vancouver Forest Region is considering specific areas within the Port Alberni Forest District for designation as community watersheds in accordance with the Forest Practices Code of British Columbia Act.

The regional manager is granted the authority under 41(8)(b) of the Forest Practices Code of British Columbia Act to propose a community watershed designation for areas which meet the following criteria:

  1. the area that is all or part of the drainage area above the most downstream point of diversion for a water use that is for human consumption and is licensed for use under the Water Act for a domestic or waterworks purpose, and

  2. areas which, in the opinion of the regional manager, Ministry of Forests, and the regional water manager, Ministry of Environment, Lands and Parks, should be designated as community watersheds.

Once designated as community watersheds, these areas become subject to the regulations of the Forest Practices Code that pertain to community watersheds. The following watersheds are candidate community watersheds:

  • Example A Creek
  • Example B Creek
  • Example C Creek
  • Example D Creek
  • Example E Creek
  • Example F Creek

Maps of the community watersheds that are proposed to be established will be available for public review and comment at the Vancouver Forest Region and the Port Alberni Forest District office for a 60-day period commencing January 8, 1996 and ending March 7, 1996.

Once a community watershed has been designated, varied or cancelled, a similar advertisement must be placed in a newspaper with the addition of: 1) the date the order takes place and 2) the fact that a copy of the order concerning the status of the community watershed is available at the Ministry of Forests regional and district offices.

Notice of Public Review

PROPOSED CANCELLATION OF COMMUNITY WATERSHED

Notice is hereby given that the regional manager of the Vancouver Forest Region is considering cancellation of Fish Hatchery Creek in the Chilliwack Forest District as a community watershed in accordance with the Forest Practices Code of British Columbia Act.

The regional manager is granted authority under section 41(11) of the Forest Practices Code of British Columbia Act to cancel an area's status as a community watershed.

Maps of this community watershed that is proposed for cancellation will be available for public review and comment at the Vancouver Forest Region and the Chilliwack Forest District for a 60-day period commencing ___________ and ending ____________.
